1. General Terms
These terms and conditions govern the relationship between PT Dunia Siber Teknologi ("We", "Us", or "Dusitek") as the provider of SiberPOS and users of the service ("You", "Customer", or the entity you represent).
By registering, downloading the application, activating a device, or using SiberPOS services, you are deemed to have read, understood, and agreed to be bound by these Terms. If you do not agree to them, you are not entitled to access or use the services.
If you accept these Terms on behalf of a business entity, you represent that you are authorized to bind that business entity, and all provisions of these Terms apply to that entity.
Certain features, packages, or programs may be subject to separate terms. In the event of a conflict, the specific terms for the relevant feature or program will apply to the relevant part.
Your use of the services is also subject to the SiberPOS Privacy Policy, which explains how personal data is collected, used, stored, and protected.
2. SiberPOS Services
SiberPOS is a business management platform for culinary businesses that includes a cashier application, back office, and supporting service channels:
- Point-of-sale system and cashier devices
- Table service and handheld devices
- QR dine-in
- Self-order kiosk
- Order display system
- Member application with points and reward settings
- Back office for sales reports, inventory, and multi-brand and multi-outlet settings
We may add, modify, or discontinue features from time to time. New features we provide become part of the services and are subject to these Terms.
The services are provided on a paid subscription basis. The availability of a free trial, the feature coverage of each package, and its activation requirements follow the information applicable at the time of purchase.
3. Registration and Accounts
To use the services, you must register an account and provide information that is accurate, current, and complete. We may verify your identity and request additional documents or information before activating your account.
You are responsible for maintaining the confidentiality of your account credentials — login email, password, and access codes for cashier devices — and for all activity that occurs through your account.
Cashier accounts are created, managed, and deleted by the business owner through the back office. The cashier application does not provide self-service account registration, so the addition and revocation of cashier access are entirely controlled by the business owner.
If you become aware of unauthorized account use, a lost device, or compromised credentials, you must notify us immediately so that access can be secured.
By providing your email address and phone number, you agree to receive service notifications through those channels. Keeping your contact information up to date is your responsibility.
4. Subscription, Payment, and Termination
Fees, packages, and billing cycles follow the information applicable at the time of purchase or subscription renewal.
We may change fees, prices, or package structures by giving you prior notice. If you do not agree to the change, you may terminate your subscription at the end of the current period.
Late payment may result in restricted or suspended access to the services until the outstanding obligation is settled.
Payments already made are non-refundable if you terminate your subscription before the end of its term. The final refund policy is determined by the service provider.
Taxes arising from subscription transactions are the responsibility of each party in accordance with applicable tax regulations.
After your subscription ends, access to the services will stop while we continue to store your business data so that it can be used again if you resubscribe. We may delete that data after 30 (thirty) days from the end of the subscription, unless we are legally required to retain it for longer.
5. Use of the Services
The access rights we grant are personal to you and may not be transferred without our consent.
You may use the services only for lawful purposes. You may not:
- Use the services for activities that violate the law or harm another party
- Access systems, data, or accounts that you are not authorized to access
- Reverse-engineer, copy, or modify our software
- Disrupt the stability of the system, network, or services used by others
- Rent, sell, or sublicense access to the services to any third party
The accuracy of the reports generated by the services depends on the accuracy of the data you enter. The transaction, inventory, pricing, and configuration data that you manage yourself remain your responsibility.
6. Availability and Maintenance
The services are provided on an as-is and as-available basis. Access may be interrupted due to scheduled maintenance, system updates, device failures, or network disruptions beyond our control.
We will endeavor to notify you of scheduled maintenance and address technical disruptions during business hours. Response-time targets and service availability levels will be specified separately if agreed upon in a subscription agreement.
We do not guarantee that the services will be completely error-free, uninterrupted, or suitable for specific needs beyond the available functions.
7. Third-Party Services and Links
Some service functions depend on third-party providers, such as payment gateways for payment processing and infrastructure and notification providers.
If you use a function involving a third-party partner, that partner's terms apply in addition to these Terms.
We are not responsible for the content, policies, or availability of third-party websites or services linked from our services. Review the terms and privacy policy of those websites before submitting any data.
8. Intellectual Property Rights
All software, interfaces, documentation, brands, logos, and other materials in the services are owned by Dusitek and protected by applicable law.
These Terms grant you a right to use the services during your subscription, not a transfer of ownership. Any use beyond what is permitted will terminate that right of use.
The SiberPOS trademarks, trade names, and logos may be used only with our written consent.
The data and content you submit remain yours. We need limited permission to process, store, and display them solely to operate the services. The use of aggregated and anonymized data for analysis, product development, or marketing materials remains subject to a decision by the service provider.
We may use any feedback, suggestions, or reports you submit to improve the services without creating additional obligations for either party.
9. Personal Data
The collection and processing of personal data are governed by the SiberPOS Privacy Policy, including rights to access, update, and delete data and how to submit related requests.
For customer data belonging to your business that is stored in the services, you are responsible for ensuring that its collection has a lawful basis and complies with applicable personal data protection requirements.
10. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect, incidental, or consequential loss — including loss of profits, business opportunities, or reputation — arising from the use of or inability to use the services.
We are also not liable for losses arising from errors in data you enter, unauthorized account use resulting from your failure to protect your credentials, disruptions to your devices or network, or actions of third-party partners beyond our control.
If we remain liable, our maximum liability is limited to the subscription fees you paid for the most recent 1 (one) subscription period.
You agree to hold us, including our officers and employees, harmless from third-party claims arising from your breach of these Terms or your use of the services.
11. Account Transfer and Termination
An account may not be transferred to another party without our written consent, and subscription benefits may not be moved between accounts.
We may suspend or terminate an account if these Terms are violated, the services are misused, or payment obligations remain outstanding. Before permanent termination, we will provide notice and an opportunity to remedy the violation, unless the violation requires immediate action.
You may terminate your subscription by submitting a request through the official channel listed in the Contact section.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Unitary State of the Republic of Indonesia.
Disputes will first be resolved through deliberation within 30 (thirty) days after notice of the dispute is received.
If deliberation does not result in an agreement, the dispute will be submitted to and resolved by the Pontianak High Court.
13. Changes to the Terms
We may update these Terms from time to time. Changes will be notified through your account or registered contact channel and will take effect on the date we specify.
Continuing to use the services after the changes take effect means that you agree to the updated Terms.
14. Miscellaneous
These Terms, together with the Privacy Policy, subscription documents, and applicable feature-specific terms, constitute a single agreement and may not be interpreted separately.
If any provision is declared invalid, the remaining provisions will remain in full force and effect.
